America First Policy Institute Files Lawsuit against HHS for hiding records related to Collusion with Big Tech
April 18, 2023
The America First Policy Institute (AFPI) announced today the filing of a lawsuit against the U.S. Department of Health and Human Services (HHS) for wrongfully withholding communication records between its employees and Big Tech companies, specifically Facebook, Google, and Twitter.
“The ‘Twitter Files’ proved the Biden Administration colluded with Big Tech to censor Americans with views contrary to its preferred official state narrative,” said Jessica Hart Steinmann, General Counsel at the America First Policy Institute. “It is unconstitutional for the government to collude with private entities to violate Americans’ First Amendment rights. This lawsuit will expose the unlawful actions of HHS and force government bureaucrats to follow the law and make these public records available to the public.”
Beginning in July 2021, AFPI submitted four Freedom of Information Act (FOIA) requests to HHS seeking communications between HHS employees and Big Tech companies. AFPI also requested any record that mentioned culturally popular terms, including “misinformation,” “fake news,” and “narrative.” After filing the requests, HHS took months to review and indicated it would take multiple years to respond while adding dismissive replies from HHS officials.
The lawsuit against HHS marks the latest effort by the America First Policy Institute to take on Big Tech. In 2021, AFPI supported and joined with lawyers fighting against Big Tech for censoring and de-platforming former President Donald J. Trump.
